What is a tax residence certificate?

Certificate of tax residency is also a certificate of the taxpayer's registered office or place of residence for tax purposes - it is a document certifying meeting the conditions to tax residence in a given country. Maybe It will help you prove to the Tax Office in Poland that you have tax residence in Norway - which will allow you to avoid paying tax in Poland. It is issued by the appropriate Tax Office - if the conditions for tax residence in Norway are confirmed, it is issued by the Norwegian Skatteetaten.

Will a tax residence certificate help in the event of an audit from the Tax Office in Poland?

Certificate of tax residency is not clear confirmation of our 100% tax residence in one of the countries. It only certifies the fulfillment of the residence conditions in a given country. Norway or Poland may issue such a document, but it does not in any way exempt you from tax liability in the other country if it results from the regulations..

This means that, for example, if the Tax Office requires us to pay additional tax due to double taxation, referring to the residence certificate will not change much in our situation, it is a minor argument. The office will require proof of being a Norwegian resident - this means meeting a number of residency requirements. The certificate itself will not matter.

What else can you do? In this case, the only document that we can handle for you in controversial situations is an individual interpretation of the National Tax Information.

What are the types of tax certificates in Norway?

In Norway, there are two types of tax certificates, which differ in the purpose of issuing them:

• registration certificate (bostedattest) – a document confirming the place of residence of a given person. It includes the address and time of residence, as well as all household members. It can only be obtained if you have a permanent personal number (i.e. you cannot have a D-number).
• confirmation of tax residence (bekreftelse på skattemessig bosted for privatpersoner) – a document confirming residence in accordance with national law or an agreement between countries (including the agreement between Poland and Norway).

How long does it take to get certified?

There is a time limit for the issuance of a tax residence certificate by Skatteetaten approx. 6 weeks from submitting the application. In addition, there is the time needed to deliver the certificate in paper form.
